CANDELA ("the Service") is a web application operated by Candela ("we", "us", "our"), based in Barcelona, Spain. The Service provides professional equipment list building tools for lighting directors and production professionals. By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information during registration. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
You agree not to: use the Service for unlawful purposes; attempt to gain unauthorized access to any part of the Service; interfere with or disrupt the Service or its infrastructure; scrape, copy, or redistribute the equipment catalogue data; create accounts through automated means; or impersonate another person or entity.
You retain ownership of all equipment lists, project data, notes, and other content you create using the Service ("Your Content"). You grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you. We do not claim any intellectual property rights over Your Content. You may export or delete Your Content at any time.
The Service, including its equipment catalogue database, software, design, and documentation, is owned by Candela and protected by intellectual property laws. The equipment catalogue is compiled from verified rental house data and is proprietary. You may not copy, modify, distribute, sell, or lease any part of the Service or its data.
During the beta period, all features are available at no charge. When paid plans are introduced, you will be notified in advance with clear pricing. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
If you are unsatisfied with the Service, you may request a refund within 30 days of your most recent payment. Refund requests should be sent to support@candelaeq.com. Refunds are processed to the original payment method within 10 business days.
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes that temporarily affect availability. We will make reasonable efforts to notify users of planned downtime in advance.
To the maximum extent permitted by law, Candela shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or available without interruption. Equipment catalogue data is provided for reference and may contain inaccuracies.
You have the right to export Your Content at any time using the export features provided by the Service. If you close your account, we will provide a reasonable period for you to export your data before deletion. Upon request, we can provide a full export of Your Content in a standard format.
You may terminate your account at any time. We may terminate or suspend your access to the Service if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.
We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Spain. Any disputes arising from these Terms or the Service shall be resolved in the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection laws that may apply in your jurisdiction.
